1. Acceptance of Terms

By accessing or using the TranslateDesk service, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must not use our service.

2. Description of Service

TranslateDesk provides a service for maintaining and translating Intercom help centers. The service may not be used for any other purpose. We reserve the right to modify or discontinue the service at any time with reasonable notice to you.

3. User Accounts

You may be required to create an account to use our service. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

4. Acceptable Use

You agree to use the service only for its intended purpose of maintaining and translating Intercom help centers. Any other use is strictly prohibited. You agree not to:

Use the service for any illegal or unauthorized purpose.
Interfere with or disrupt the service or servers or networks connected to the service.
Attempt to gain unauthorized access to any part of the service, other accounts, computer systems, or networks connected to the service.
Use the service in any manner that could damage, disable, overburden, or impair it.

5. Payment and Refunds

Payment processing is handled by Lemon Squeezy. All fees are non-refundable except as expressly set forth in our refund policy or as required by applicable law. Refunds are subject to our refund policy, which can be requested by contacting jona@translatedesk.io.

6. Intellectual Property

All content and functionality of the TranslateDesk service, including but not limited to text, graphics, logos, and software, is the exclusive property of TranslateDesk and its licensors and is protected by intellectual property laws. You may not reproduce, modify, distribute, or otherwise use any content without our prior written consent.

7. Limitation of Liability

To the fullest extent permitted by law, TranslateDesk shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, data loss, or business interruption, arising out of or in connection with your use of or inability to use the service, even if we have been advised of the possibility of such damages.

8. Termination

We reserve the right to terminate or suspend your account and access to the service at our sole discretion, with reasonable notice, for conduct that we believe violates these Terms of Service, is harmful to other users, us, or third parties, or for any other reason. Upon termination, your right to use the service will immediately cease.

9. Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information. By using the service, you agree to the collection and use of information in accordance with the Privacy Policy.

10. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of any material changes via email or through the service at least 30 days before the changes take effect. Your continued use of the service after such modifications will constitute your acknowledgment and acceptance of the modified terms.

11. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located within Paris, France for the resolution of any disputes arising out of or relating to these Terms of Service or your use of the service.

12. Dispute Resolution

Any disputes arising out of or relating to these Terms of Service or the service will be resolved through the competent courts in Paris, France. The court's decision will be final and binding. Each party will bear its own costs and expenses in connection with the legal proceedings, unless otherwise determined by the court.

13. Severability

If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. The invalid or unenforceable provision will be replaced by a valid and enforceable provision that most closely matches the intent of the original provision.

14. Entire Agreement

These Terms of Service, along with any other legal notices and agreements published by us on the service, constitute the entire agreement between you and TranslateDesk regarding the service and supersede all prior agreements and understandings, whether written or oral, regarding the service.

15. Consumer Rights

If you are a consumer, nothing in these Terms of Service shall affect your statutory rights under applicable consumer protection laws.
